REDDIT USER PUSHES BACK AGAINST ILLEGAL DEPARTMENT OF HOMELAND SECURITY SURVEILLANCE <\/strong><\/p>\n

San Francisco, California – Today, Civil Liberties Defense Center (CLDC) filed a motion to quash (a motion to stop a person or entity from complying with an illegal process) in US District Court in San Francisco, on behalf of J. Doe, an anonymous Reddit user and United States citizen. Department of Homeland Security (DHS) issued a \u201csummons\u201d to Reddit, demanding that Reddit secretly produce extensive private information about J. Doe to DHS, without any lawful authority to do so. This is an example of the federal government\u2019s continued attempts to use illegal tactics to attempt to bully and oppress those Americans who vehemently oppose the current authoritarian regime\u2019s policies and practices.<\/p>\n

\u201cIt is a clear First Amendment free speech violation for Big Brother to be spying on political speech and debate, whether online or in the streets. It goes a step further for the government to try and chill First Amendment rights, by trying to unmask and expose people who engage in constitutionally protected anonymous speech,\u201d said Lauren Regan, Director of Litigation & Advocacy for CLDC.<\/p>\n

The Supreme Court has repeatedly ruled that a government investigation that \u201cintrudes into the area of constitutionally protected rights of speech, press, association and petition\u201d requires the government to \u201cconvincingly show a substantial relation between the information sought and a subject of overriding and compelling state interest.[1]<\/a>\u201d The government summons entirely fails to do so in this instance.<\/p>\n

Our client. Reddit user J. Doe, stated: \u201cIn times like these I\u2019m thankful for organizations like CLDC whose diligent work protecting online privacy and freedom of speech keeps environmental and social justice activists safe from authoritarians. This subpoena only emboldens me– I will not be silenced by DHS.\u201d<\/p>\n

CLDC is aware that many other Reddit users (as well as Facebook\/META users) have received similar notifications that DHS and\/or ICE are demanding their personal information. Most people would not have the resources or legal expertise to fight these serious violations of constitutional law. If this motion to quash the summons is granted, Reddit will not be required to produce any information about J. Doe to the federal government. Because the Court will likely rule that there is no legal basis requiring Reddit to comply with this type of summons, it may also apply to any other Reddit users who have received similar notices from Reddit regarding a summons from DHS and\/or ICE.<\/p>\n
