{"id":17376,"date":"2025-11-06T12:19:21","date_gmt":"2025-11-06T20:19:21","guid":{"rendered":"https:\/\/cldc.wagonwheelweb.com\/?p=17376"},"modified":"2026-04-03T19:06:09","modified_gmt":"2026-04-04T02:06:09","slug":"know-your-rights-when-posting-about-ice","status":"publish","type":"post","link":"https:\/\/cldc.org\/hi\/know-your-rights-when-posting-about-ice\/","title":{"rendered":"Know Your Rights When Posting About ICE"},"content":{"rendered":"<p class=\"p1\">The extent of the <a href=\"https:\/\/www.independent.co.uk\/news\/world\/americas\/us-politics\/us-citizen-assaulted-border-patrol-chicago-halloween-parade-b2853988.html\"><span class=\"s1\">brutal tactics<\/span><\/a> used by ICE in its assault on people and<span class=\"Apple-converted-space\">\u00a0 <\/span>US cities has been made public only through the bravery of <a href=\"https:\/\/www.reuters.com\/legal\/government\/citizens-are-tracking-ice-real-time-warn-migrants-is-that-legal-2025-09-04\/\"><span class=\"s1\">citizen journalists and activists<\/span><\/a> who document ICE activity and post it online. In response, ICE has <a href=\"https:\/\/truthout.org\/articles\/trumps-ice-turns-its-target-to-activists-not-just-immigrants\/\"><span class=\"s1\">targeted those activists<\/span><\/a>. The point of this repression is to stifle free speech, and the antidote is a confident understanding of your rights when posting online. Here is what you need to know:<\/p>\n<ul class=\"ul1\">\n<li class=\"li1\">It is <b>completely legal<\/b> to document police activity in public, <a href=\"https:\/\/www.eff.org\/deeplinks\/2025\/02\/yes-you-have-right-film-ice\"><span class=\"s1\">including ICE<\/span><\/a> \u2013 however, there are limits to where a person can be physically while recording.<\/li>\n<\/ul>\n<p class=\"p2\">In particular, if an officer gives you a direction like \u201cstand back\u201d or \u201cmove over there\u201d you should follow their direction. Otherwise, you may be risking arrest for interfering with the arrest or detention.<\/p>\n<ul class=\"ul1\">\n<li class=\"li1\">Criticism, even if strongly worded or offensive &#8212; is protected by the First Amendment and is legal; however ,\u201ctrue threats\u201d are not. A \u201c<a href=\"https:\/\/www.supremecourt.gov\/opinions\/22pdf\/22-138_43j7.pdf\"><span class=\"s1\">true threat<\/span><\/a>\u201d is a statement where the speaker states they are going to commit an act of unlawful violence.\n<ul class=\"ul1\">\n<li class=\"li1\">Courts look at intent in two ways when analyzing a \u201ctrue threat.\u201d <span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span>\n<ul class=\"ul2\">\n<li class=\"li1\">Subjective Intent: Did the speaker either intend to threaten, or \u201cconsciously disregard a substantial and unjustifiable risk\u201d that their conduct will cause harm to someone?<\/li>\n<li class=\"li1\">Objective Intent: Would a reasonable person interpret the speech as threatening?<\/li>\n<\/ul>\n<\/li>\n<li class=\"li1\">This is true for posts about anyone, not just ICE.<\/li>\n<\/ul>\n<\/li>\n<li class=\"li1\">Public information is fair game; private information is not.\n<ul class=\"ul1\">\n<li class=\"li1\">ICE agents fall into a category of <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/119\"><span class=\"s1\">protected federal worker<\/span><\/a>, meaning there are legal limits on what can be posted about them, that are different than the rules for normal people.<\/li>\n<li class=\"li1\">Anything made publicly available through government documents, or on the agent\u2019s uniform &#8212; such as name, department, rank, or salary information &#8212; are legal to post.<\/li>\n<li class=\"li1\">It is illegal to post home addresses, cell phone numbers, personal email addresses, or other <a href=\"https:\/\/www.law.cornell.edu\/definitions\/uscode.php?width=840&amp;height=800&amp;iframe=true&amp;def_id=18-USC-2002917903-1882812377&amp;term_occur=999&amp;term_src=title:18:part:I:chapter:7:section:119\"><span class=\"s1\">personally identifying information<\/span><\/a> belonging to the agent or their family members.<\/li>\n<li class=\"li1\">This protection extends to <a href=\"https:\/\/www.justice.gov\/usao-cdca\/pr\/federal-grand-jury-charges-three-women-following-ice-agent-home-work-and-livestreaming\"><span class=\"s1\">filming agents at their home<\/span><\/a> or posting such videos.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p class=\"p1\">Beyond your rights regarding individual posts, there are some extra things to keep in mind when documenting ICE or any other police agency online:<\/p>\n<ul class=\"ul1\">\n<li class=\"li1\">Interpret the rules more strictly if you are a non-citizen, even if you have legal status.\n<ul class=\"ul1\">\n<li class=\"li1\">The administration is <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/oct\/14\/us-foreign-visas-charlie-kirk-social-media\"><span class=\"s1\">applying a heavy political bias<\/span><\/a> in determinations around people\u2019s status.<\/li>\n<li class=\"li1\">Because every immigration issue is fact-specific, if you have concerns, seek out an opinion from a qualified immigration attorney.<\/li>\n<\/ul>\n<\/li>\n<li class=\"li1\">Be cautious if you are traveling in and out of the country. Re-entering the country after a trip abroad is a risky situation for what would ordinarily be your Fourth Amendment rights. Customs, Homeland Security, and\/or Border Patrol can seize and search a phone for a variety of reasons. <a href=\"https:\/\/activistchecklist.org\/travel\/\"><span class=\"s1\">Brush up on your rights<\/span><\/a> while traveling outside of the U.S., and consider bringing a <a href=\"https:\/\/www.cnet.com\/tech\/mobile\/think-about-buying-a-burner-phone-when-you-get-your-holiday-tickets-this-year\/\"><span class=\"s1\">burner device<\/span><\/a> for use while out of the country.<\/li>\n<\/ul>\n<ul class=\"ul1\">\n<li class=\"li1\">ICE\/DHS is attempting to subpoena social media account information from META and Google. Currently, CLDC represents an anonymous speaker who posts public info about ICE activity, pushing back against an \u201cadministrative\u201d subpoena ICE served on Meta demanding user account info. We filed a motion to quash, and the court granted a temporary stay against META disclosing the info while the case proceeds, and we are set for a hearing in January.<\/li>\n<\/ul>\n<p class=\"p1\">With ICE totally unrestrained, it is a scary time for civil liberties.
