{"id":18524,"date":"2026-06-23T10:22:20","date_gmt":"2026-06-23T17:22:20","guid":{"rendered":"https:\/\/cldc.org\/?p=18524"},"modified":"2026-06-23T10:22:20","modified_gmt":"2026-06-23T17:22:20","slug":"civil-liberties-defense-center-announces-resounding-win-in-federal-free-speech-plaza-lawsuit","status":"publish","type":"post","link":"https:\/\/cldc.org\/hi\/civil-liberties-defense-center-announces-resounding-win-in-federal-free-speech-plaza-lawsuit\/","title":{"rendered":"Civil Liberties Defense Center Announces Resounding Win in  Federal Free Speech Plaza Lawsuit"},"content":{"rendered":"<p><strong>FOR IMMEDIATE RELEASE<\/strong><\/p>\n<p>&nbsp;<\/p>\n<h2 style=\"text-align: center;\"><strong>Civil Liberties Defense Center Announces Resounding Win in <\/strong><\/h2>\n<h2 style=\"text-align: center;\"><strong>Federal Free Speech Plaza Lawsuit<\/strong><\/h2>\n<h2 style=\"text-align: center;\"><\/h2>\n<p>Eugene, OR \u2013 Today, in a resounding win for the First Amendment, the federal district court ordered the federal government to take down the fence around Free Speech Plaza within 48 hours.\u00a0 This is in response to the General Services Administration (GSA) erecting a tall barrier fence around Free Speech Plaza reducing the 52,000 square foot community gathering space by almost 90%.<\/p>\n<p>Less than three weeks after CLDC filed this constitutional challenge, Federal District Judge Mustafa Kasubhai ruled in favor of CLDC\u2019s request for a preliminary injunction. In issuing the injunction, Judge Kasubhai ruled that the plaintiff activists had proved by \u201cclear and convincing evidence\u201d the fenced-off area is a \u201ctraditional public forum,\u201d and that they have a strong likelihood of success in proving the government violated the First Amendment by erecting a fence that dramatically reduced the area to assemble and engage in free expression. The judge also found that the detailed testimony of six witnesses who took the stand clearly demonstrated ongoing harm to the plaintiffs\u2019 and public\u2019s rights.<\/p>\n<p>Marianne Dugan, CLDC\u2019s lead attorney on this case, added \u201cWe are absolutely thrilled the court did right by Eugene residents. The federal Free Speech Plaza has served as an important public gathering area in Eugene for the community to exercise its First Amendment Rights, for more than fifty years. Today\u2019s decision by Judge Kasubhai is the result of that community showing up and speaking out day after day.
